2. SCOPE OF WORK

Note: The scope of work section will be filled in by Clauson Landscaping LLC after we discuss your project. We'll add the specific services, description, and details before the contract is countersigned and returned to you.

3. PROJECT TIMELINE

Estimated timelines are provided in good faith and are not guaranteed. Clauson Landscaping LLC is not liable for delays caused by weather, material availability, permitting, or other conditions outside of our control.

4. PRICING & PAYMENT

Accepted Payment Methods: Cash • QuickBooks Invoice (Credit Card, Debit Card, Apple Pay, Bank Transfer)

Processing Fees: 3.5% for Credit/Debit/Apple Pay; 1% for Bank Transfer. No fee for cash.

Late Payments: A 10% price increase will be applied to any unpaid balance more than 7 days past due.

5–11. TERMS & CONDITIONS

5. Change Orders

Any changes to the agreed scope of work must be approved in writing by both parties via a signed Change Order before work proceeds. Verbal agreements to change scope will not be honored.

6. Property Access & Condition

Customer grants access to the property on agreed service dates during normal business hours.
Customer is responsible for identifying and marking all underground utilities, irrigation systems, invisible fencing, and any other hazards prior to work beginning.
Customer is responsible for obtaining any permits required for the described work.

7. Liability & Limitation of Damages

Clauson Landscaping LLC carries general liability insurance.
Not responsible for pre-existing conditions, underground utilities, or items not clearly marked before work began.
Liability is capped at the amount paid by the Customer for the specific work performed.
Any damage must be reported in writing within 48 hours of the service visit.
Survival of installed plants or sod is not guaranteed unless a separate written plant warranty is provided.

8. Debris, Materials & Disposal

Unless otherwise stated, all debris generated during the project will be hauled away by Clauson Landscaping LLC.
Materials specified in the scope will be sourced by Clauson Landscaping LLC. Customer-supplied materials are accepted but quality/suitability is not guaranteed.

10. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the State of Idaho. Disputes shall first be attempted in good faith, then submitted to binding arbitration or the appropriate Idaho state court.

11. Entire Agreement

This contract constitutes the entire agreement between Clauson Landscaping LLC and the Customer. Any modifications must be made in writing and signed by both parties.

9. PHOTO RELEASE

Clauson Landscaping LLC may photograph completed work for use in marketing, social media, and portfolio purposes. No identifying information about the Customer or property address will be shared.
